CCPD refers six juveniles to city court related to CCJHS assault

Six juveniles were issued summons to the Copperas Cove Municipal Court in connection with a recent incident at Copperas Cove Junior High School, said Sgt. Kevin Miller with the Copperas Cove Police Department on Friday. 
The six juveniles were issued summons for Disorderly Conduct/Public Affray in connection with the alleged physical assault of a student on the afternoon of Friday, October 20, while school was in session.
“If any other evidence turns up, there could be additional assault charges filed,” Miller added. 
The Copperas Cove Independent School District issued a statement earlier last week, confirming that the investigation is also being managed through CCISD’s Student Code of Conduct discipline plan. This is in addition to the summons to city court.
According to CCISD’s student code of conduct, mandatory disciplinary action which includes being referred to the district’s Disciplinary Alternative Education Program, or DAEP, is contingent upon several things which a campus’ behavior coordinator shall take into consideration to include self-defense, Intent or lack of intent at the time the student engaged in the conduct, a student’s disciplinary history, or a disability that “substantially impairs the student’s capacity to appreciate the wrongfulness of the student’s conduct.”
Also in accordance with state law, a student may be placed in DAEP for “assault by offensive or provocative physical contact” and mandatory placement in DAEP will occur if a student “commits an assault under Texas Penal Code 22.01(a)(1).”
